Please read these Terms & Conditions ("Terms", "Terms of Use") carefully before using the Tomat website and the Tomat app (the "Service") operated by Retable, Inc ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. License

Subject to your compliance with these Terms, Tomat.ai grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial purposes or your internal business use only. This license shall remain in effect unless and until it is terminated by you or us.

2. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

3. Subscriptions and Payments

Tomat.ai is offered as a subscription-based service. New users receive a 7-day free trial of our Solo Plan, during which no payment information is required. Upon expiry of the trial period, continued access to the service requires subscription to the Solo Plan at a monthly fee of $7. At this point, you will be prompted to enter your payment information.

Billing: Billing commences immediately upon subscription and recurs automatically every 30 days through our payment partner, Stripe.
Payment Processing: All transactions, including the processing of payment information, are securely handled by Stripe. Retable, Inc. does not store your credit card or other payment details.
Renewal: At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or Tomat cancels it. You may cancel your subscription renewal through your online account management page.

4. Refunds

Requests for refunds may be considered on a case-by-case basis and are granted at the sole discretion of Tomat.ai. To cancel or request a refund for erroneous charges, navigate to the Account & Preferences page, select the Billing tab, and click the Manage Billing button. This action will open your browser and direct you to the Stripe portal.

5. Modifications to the Service and Prices

Tomat.ai reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without notice. Prices of all Services are subject to change upon 30 days' notice from us. Such notice may be provided at any time by posting the changes to the Tomat site or the Service itself.

6. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Tomat.ai. Tomat.ai has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Tomat.ai shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

7. Limitation of Liability

In no event shall Tomat.ai, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
